Terms and conditions of use

These Terms and Conditions govern the operation and use of the website https://www.edp.com (“Site”), made available and operated by EDP, S.A., with its registered office at Avenida 24 de Julho, no. 12, in Lisbon, Portugal, with commercial registry number 500697256 (“EDP”).
The user of this Site (“User”) acknowledges that the use thereof implies acceptance of these Terms and Conditions, as well as the Privacy Policy, and Cookie Policy, which are complementary thereto (together, “Contractual Documentation”). If the User does not accept the Contractual Documentation, they must cease using the Site.

A. Site Description
The Site aims to provide Users with information about the activity and initiatives of EDP or other companies of the EDP Group.
The information provided has been subject to a thorough review; however, such information is merely indicative and may contain errors or inaccuracies, or may not always be duly updated.
The Site also enables the User to subscribe to online newsletters, register for various initiatives and make contact requests or request information from EDP.

B. Access to the Site
    1.    The User may access the Site through her/his browser.
    2.    EDP has the exclusive right, at any time, to suspend, partially or totally, access to the Site, particularly for management, maintenance, repair, alteration or modernisation operations. EDP also has the right to close, definitively or temporarily, partially or totally, the Site at any time.

C. Functionalities
    1.    Access to and use of the Site does not depend on prior registration by the User nor on the provision of personal data. However, to access certain functionalities, namely subscription to newsletters, registration in initiatives or contact and information requests, the User must provide certain personal data through the forms made available for that purpose. The provision of such data is governed by the Privacy Policy.
    2.    By providing their data on the Site, the User declares that:
(i) They are over eighteen (18) years of age;
(ii) They have not previously been suspended or removed from the use of the Site;
(iii) All information provided is true, complete, accurate, current and authentic;
(iv) They use the functionalities of the Site in accordance with all applicable legislation and regulation.
    3.    Access to the functionalities of the Site by the User may be suspended or cancelled by EDP if the User breaches the rules set out in the Contractual Documentation.
    4.    EDP shall not be responsible for the content that may be made available in the forms or in the newsletters, nor for any damages arising from errors in the insertion of information by the User. The User shall refrain from inserting in the forms personal data of third parties who have not been duly informed of the terms of personal data processing and/or have not given their consent for that purpose, as provided for in our Privacy Policy.

D. General conditions of use of the Site
    1.    The User acknowledges that they must use the Site in a responsible, prudent and careful manner, refraining from adopting conduct contrary to the law.
    2.    The User shall not use the Site to send or make available information or content belonging to third parties which they do not have the right to use.
    3.    The User shall not use the Site to make available or transmit any type of material that contains or may contain viruses, worms, defects, or any other items or computer codes, files or programmes that are likely to interrupt, destroy or limit the functionality of any equipment or computer system (hardware or software) or communications equipment.
    4.    The User shall not carry out any acts that may cause damage, put at risk, disrupt or degrade the integrity, continuity or quality of the Site and its resources, including, namely:
(i) breach of authentication or security systems protecting access accounts, servers, services or networks;
(ii) unauthorised access to or obtaining of any third-party data, personal or non-personal, with any type of Phishing practice being prohibited;
(iii) unauthorised search for vulnerabilities or weaknesses in servers, services or networks, in particular systematic detection of response to services;
(iv) access to computer systems, services or networks without the express authorisation of the relevant responsible parties or owners;
(v) overload actions aimed at sabotaging or which sabotage the functioning of the Site; and
(vi) illegal or undue interception and/or interference (and attempts thereof) in any data, systems or equipment, without authorisation to do so.
    5.    The User acknowledges that their use of the Site is at their own risk, being solely responsible for any damage caused to their system and/or computer equipment or for any other damages or losses, including loss or corruption of data, resulting from the use of materials, content or information obtained, by any means, through the Site, the forms or the newsletters of EDP.

E. Links to other websites
    1.    EDP may provide links to websites of other entities. These websites do not belong to, nor are they operated or controlled by EDP, and therefore EDP is not responsible for, does not approve or in any way support or endorse the content of such websites, nor of websites linked to or referred to therein.
    2.    EDP shall not be responsible for damages resulting from viruses that may infect the User’s computer or network, or other assets, as a result of access to the Site with transfer of content from it to the User’s computer or network. The use of such links is the sole responsibility of the Users.

F. Intellectual Property
    1.    The User acknowledges that the Site, its structure and layout, the selection, organisation and presentation of its content, including texts, images, graphics, forms, newsletters, functionalities and software used on the Site, as well as the trademarks, logos and symbols displayed, are protected by intellectual property rights, being owned by EDP or used by EDP under appropriate authorisation, and the User undertakes to respect such rights.
    2.    The User is not authorised to transmit, make available to the public, modify, transform, copy, sell, use or distribute, in any way, the texts, images or other information contained on this Site and in the newsletters or any part thereof without prior written authorisation from EDP. The use of trademarks and logos on this Site and in the newsletters does not grant, nor may it be construed as granting, permission to the User to use, directly or indirectly, such trademarks, logos or materials.

G. Personal Data Processing and Cookies

H. Liability and Warranties
    1.    The information presented on the Site shall not be interpreted by the User as an offer or commercial proposal by EDP, or by any third party, to sell to or contract with Users any product or service.
    2.    The information made available on the Site does not constitute, regardless of the form it may take, advice or a recommendation to buy, sell or contract, and does not dispense with consulting specialists where necessary.
    3.    All information contained on the Site is intended exclusively for private use, and its use for commercial purposes is prohibited.
    4.    The User acknowledges and accepts that EDP shall not be responsible for any material or personal damage or loss that may arise directly or indirectly from:
(i) any use of the information made available, the User being solely and exclusively responsible for all decisions taken on the basis of such information;
(ii) any unauthorised use of EDP’s servers and/or all information and data stored therein, nor for the accuracy, timeliness or truthfulness of the information contained in the contents, nor for any errors, defects or inaccuracies of the contents and for any damages that such errors, defects or inaccuracies may cause to the User;
(iii) impossibility, delay, suspension or interruption in access to the Site due to technical failures or other reasons;
(iv) use or inability to use the Site, including, namely, delays, interruptions, errors, interferences, disturbances and suspension of communications, omissions, viruses, bugs, IT incidents and also breakdowns and/or malfunctions of the electronic, computer or telecommunications system;
(v) delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems, namely failures in accessing any part of the Site;
(vi) unlawful acts of third parties;
(vii) possible errors or security deficiencies that may arise from the use of a terminal device or an outdated or insecure browser, or from damages, errors or inaccuracies that may result from their malfunction.
    5.    In order to ensure the availability and integrity of the Site, EDP may monitor traffic with the aim of identifying unauthorised attempts to access or alter content, or which may otherwise compromise the Site.
    6.    Unauthorised attempts to modify, alter, destroy or corrupt the information contained on the Site, to analyse or compromise security conditions, to install unauthorised software, or to use this system for purposes other than those described herein, are prohibited and will be reported to the competent authorities, including collected evidence, for the application of legally provided sanctions.
    7.    EDP does not guarantee that:
(i) the Site meets or is fit to meet any needs or expectations of the User;
(ii) the User will not incur indirect losses or damages that would not have been foreseeable by the User when accessing or using the Site;
(iii) the User will not incur losses or damages as a result of any product or service acquired through third-party websites accessed through the Site or due to any acts, omissions, errors or negligence of third parties;
(iv) the Site is fully immune to hacker attacks and viruses or other intrusive software.

I. Final provisions
    1.    EDP reserves the right, at any time, to amend, add, update or remove, partially or totally, these Terms and Conditions.
    2.    The User should periodically consult the page of these Terms and Conditions to confirm whether any updates or changes have been made.
    3.    Should any provision of these Terms and Conditions be declared null, ineffective, be annulled, or be in any way unenforceable, this shall not affect the validity or effectiveness of the remaining clauses, which shall remain fully in force.
    4.    If the User has any questions or wishes to submit any complaint regarding the Terms and Conditions, they must contact EDP by sending a written request through the following contact form.
    5.    The Contractual Documentation shall be governed by Portuguese law. All disputes relating to its validity, interpretation and performance shall be settled by the competent courts of the Lisbon district, with express waiver of any other jurisdiction.
